Bethlehem Township mental health center appeal dropped

BETHLEHEM TWP., Pa. -

An appeal to develop an eight-bed adult mental health treatment center on Wednesday night in Bethlehem Township never happened.

The appeal scheduled before the five-member Zoning Hearing Board was withdrawn without prejudice, according to Bethlehem Township Zoning Officer Deborah Roseberry.

NHS Human Services, the health services company who proposed to build the facility at the northeast intersection of Brodhead Road and Fritch Drive, according to the township, withdrew the request.

“Withdrawn without prejudice” is a legal term that means a reservation made on a statement or offer that is not an admission or cannot otherwise be used against the issuing party in future dealings or litigation with any determinative legal effect.

NHS had been seeking a special exception from the zoning hearing board to construct a secured locked one-story structure that would have housed eight individual residential rooms for an extended acute care program for patients with mental problems.

The planners did not take the night off, however, voting 5-0 to grant variances requests to develop a vacant lot located near the just north of the intersection of Washington and Seventh streets to Cuzo Properties, LLC. The property is located in what is called the “Medium Density Residential Zoning District,” according to the township.
