POTTSVILLE, Pa. -

A wrongful death lawsuit filed against a scrutinized Schuylkill County community has been settled out of court.

David Vega's family has settled with the borough of Shenandoah, former police Chief Matthew Nestor and Capt. Jamie Gennarini for $600,000, according to the Pottsville Republican-Herald newspaper.

Vega's family claimed Nestor and Gennarini killed Vega in police custody in 2004 and tried to make it look like a suicide.

The Shenandoah Borough Council has yet to approve the settlement.

Nestor and Gennarini are awaiting trial after they pleaded not guilty to extorting money from illegal gambling operations.

Nestor was also convicted of falsifying a police report in connection with the high-profile beating death of illegal immigrant Luis Ramirez.
