Schultz wants perjury charges thrown out

STATE COLLEGE, Pa. -

Another Penn State official facing perjury charges wants them thrown out.

Lawyers for former university vice president Gary Schultz filed the motion Tuesday, a day after athletic director Tim Curley made the same request.

Both Schultz and Curley are charged with perjury and failing to report allegations of child sex abuse against former assistant football coach Jerry Sandusky.

Both argue that the law was different in 2002, when they  received a report of Sandusky being in the showers with a young boy.

They also say the statute of limitations has run out.

The attorney general's office says it hasn't received the filings but will review them when it has.  

Sandusky denies molesting boys.
