Criminal complaint: Schuylkill murder suspect said, "I shot him"

WEST MAHANOY TWP., Pa. - Moments after shooting and killing his neighbor following a dispute Saturday, police in Schuylkill County said 66-year-old Ronald Kozak admitted to the crime.

"I shot him. I don't know where I hit him, but I shot him," Kozak is quoted as saying in the criminal complaint charging him with criminal homicide in the West Mahanoy Township shooting. Police said Kozak made this comment while police advised him of his right to remain silent.

The criminal complaint details the circumstances that led to the fatal shooting of 60-year-old Joseph Boris. Police said the two neighbors did have an ongoing property dispute dating back several years.

According to the affidavit of probable cause, Boris and his wife were approached by Kozak and his wife in the garage of Boris' home in the 500 block of Indiana Avenue around 11:30 a.m. Saturday.

As Kozak approached the garage area with a handgun in his possession, Boris reportedly grabbed a hose and sprayed water at Kozak, according to the affidavit. Kozak then entered the garage, forcing Boris to retreat to the back of the garage, the affidavit states.

A physical confrontation ensued, at which time Boris told Kozak to leave his property, the affidavit states. The physical confrontation continued from the garage into a nearby carport. Kozak then pulled out a gun and fired a single shot into the left side of Boris' chest, according to the affidavit.

Boris' wife witnessed the confrontation and heard a "pop" before seeing her husband "retreat backwards, walk towards the garage and collapse onto the ground," the affidavit states. She also witnessed seeing a black gun in the hand of Kozak.

Officials said Boris was pronounced dead at the scene.

Kozak is being held at Schuylkill County Prison.
