Ex-cop wants evidence tossed

The attorney for a former cop charged with causing a deadly drunk driving crash in Northampton County wants a judge to toss out evidence.

The lawyer for John Heaney III, 49, asked a judge Friday to throw out statements by Heaney following the crash that killed two motorcyclists in Bangor last summer.

He said the statements were made before Heaney received a Miranda warning.

The attorney has also asked the judge not to allow police video showing Heaney taking a sobriety test.

Heaney is scheduled to stand trial in May.

The family of the two men killed  filed lawsuit against Heaney and three bars that allegedly served  him the night of the accident, earlier this month.
