Atiyeh projects remain on hold after judge's ruling

Lehigh County Judge Carol McGinley stalled two of developer Abe Atiyeh's projects in a ruling issued Wednesday. But Atiyeh says he's not giving up on either development.

The developer told 69 News that his plans for a treatment center along Route 378 in Bethlehem were denied by the judge in her ruling. Atiyeh said the center had been approved by the Bethlehem Zoning Hearing Board, however, City Council appealed the approval. According to Atiyeh, the treatment center is now permitted under a "special exception." That special exception did not exist when the appeal had been filed, Atiyeh said. Based on that, Atiyeh said he will appeal the judge's ruling.

McGinley also denied permission for an electronic billboard on the same property. That billboard would face Route 378, according to Atiyeh. Atiyeh said he will appeal that decision because, "the city is exclusionary" in allowing electronic billboards such as the one he is proposing.
