DA: No charges in fatal shooting of man in Allentown

August shooting appears to have been self-defense

ALLENTOWN, Pa. - No charges will be filed in the fatal shooting of a 35-year-old Allentown man last month, according to the Lehigh County district attorney's office.

Alberto Montanez, of East Cedar Street in Allentown, was shot and killed in the 1100 block of Allen Street in the city on August 26.

Lehigh County District Attorney Jim Martin said in a brief news release that Allentown police Det. Amaury Almonte and Det. Joseph Vazquez, with the county's homicide task force, completed a "full, complete and extensive investigation" into the shooting.

"As a result of the investigation, the shooting appears to have been justified as self-defense, and no criminal charges can be proven beyond a reasonable doubt," Martin said in the release.

The shooting was initially reported about 5:45 a.m. August 26. Investigators at the time said Montanez was found in the driver's seat of a vehicle at the shooting scene.
