Family sues over fatal ATV accident after Hurricane Sandy

PLAINFIELD TWP., Pa. - The parents of a teenager who died after an ATV accident are suing the ATV's driver, his mother and Plainfield Township.

Cathy Vaughn and Robert D. Mills, Sr., have filed a lawsuit in Northampton County Court stemming from an ATV accident that resulted in the death of Robert D. Mills, Jr., 17.

The lawsuit alleges that Karen Skorochod told her son, Anthony Skorochod, to drive their "unlicensed" and "unregistered" Yamaha four-wheeler to a neighbor's house to borrow their generator at the onset of Hurricane Sandy on October 29, 2012.

The lawsuit alleges that Anthony Skorochod "observed a large tree had fallen across the lane of travel and ducked in order to avoid striking the tree without warning [Mills] of the presence of the tree.

According to the Lehigh County Coroner, Mills died of severe heard injuries after being ejected from his seat when the ATV he was on struck a tree on West Chester Street in Plainfield Township.

had "an inoperable headlamp and a faulty braking lamp" and Skorochod was speeding and was drunk at the time of the accident.

Mill's parents are also hold Plainfield Township liable in the suit for not dealing with the safety issues of a fallen tree in the road before an accident occurred.
