Mayor Pawlowski due in court ahead of January trial

PHILADELPHIA - Allentown Mayor Ed Pawlowski and his lawyer will be in federal court in Philadelphia Tuesday to hash out the terms of his trial in January.

If Pawlowski's attorney gets his way, the whole pay-to-play case will get tossed, but federal prosecutors want the trial to move forward as planned.

In court, attorneys will discuss everything from Pawlowski trying to get the case thrown out to exhibits that attorneys will likely present to a jury.

Many of those exhibits are recorded conversations, involving the mayor or other various people, talking about everything from wiretapping concerns, to campaign funds, even questions about certain ethical decisions.

Another exhibit is a letter from Pawlowski's attorney to the Department of Justice, asking them to investigate the mayor's former campaign manager, Michael Fleck, accusing him of "serious misappropriation of campaign funds."

Exhibit F is a police report that accuses Fleck of opening a fraudulent credit card in someone else's name. It includes an attached bank statement, that shows a balance of $14,629.

The judge could make a decision in the courtroom about whether to throw out the mayor's request to have the charges dropped.

But there's still more time for both sides to file other motions, or responses to the other side, before a final pretrial conference is held on January 4th, ahead of the trial on January 18th.
