A Berks County high school student has slapped his school district with a lawsuit.

The suit claims it all stems from a sex video that landed him a suspension, and now the student, Anders Hemdal, is fighting his punishment, saying it was unwarranted.

Hemdal, a junior at Schuylkill Valley High School, returned from a 10-day trip to Morocco in April.

According to the lawsuit, which was filed last week in federal court in Philadelphia against the Schuylkill Valley School District, Hemdal, 16, realized a fellow student secretly recorded him having sex. School officials suspended all three teenagers, but Hemdal argued his rights and privacy were violated.

In the suit, attorneys representing Hamdal said the student was handed an unfair punishment after the sex video surfaced.

"Pennsylvania law is very specific that schools can only regulate conduct that is occurring on school property," said Joshua Price, attorney with Prince Law Offices, P.C. in Bechtelsville, who is handling the case.

Hemdal was on the school-sponsored trip to Morocco last spring with the Spanish club. The suit claims another student secretly used a cell phone to record Hemdal having consensual sex with his then-girlfriend.

"When he got back to school, the student who recorded it started distributing it to other students," said Prince.

According to the claim, that's when Hemdal became aware of the video and told his parents. They, in turn, brought it to the attention of the school administration. His attorneys claim a memo was sent out to the educators identifying the two students in the video, and without a hearing, Hemdal and the other students received a four-day suspension.

"This is part of his record now that he's been suspended, and he was never given a hearing as required by Pa. law," said Prince.

Hemdal's parents told 69 News their son has been humiliated and bullied, and argue he never broke the student code of conduct.

The suit was filed last week against the former superintendent, Solomon Lausch, Schuylkill Valley High School principal David Haughney and assistant principal Joshua Kuehner. Hemdal is asking for his records to be expunged and compensation for legal fees and damages.

"They're worried about their son and about his record. They feel he was treated unfairly. The main issue is having these records destroyed," said Prince.

According to the suit, charges have been filed and are pending in juvenile court for the student who shot the video, who was not named.

The school district said it has not seen the lawsuit and has no comment.
