DA: No criminal charges in accident that killed man, destroyed Leithsville Fire Company building
No criminal charges will be filed in a fiery accident that killed a man at the Leithsville Fire Company in Northampton County last May.
District Attorney John Morganelli said no charges will be filed because no "criminality" was involved in the accident.
The driver, Michael Thomas was not speeding, nor was he under the influence of alcohol, when his dump truck crashed into the fire department building, killing John Muzyka, 56, of Springfield Township, Morganelli said. The building also caught fire and was destroyed.
At the time of the accident, witnesses and emergency workers said they believed everyone escaped the building and Thomas, 42, got out of the truck. Hours later, they learned another vehicle was involved. It had been hit by the truck and dragged into the building, the coroner said.
Morganelli called the accident "very tragic," saying the dump truck's brakes did not operate properly, so Thomas couldn’t stop,
Morganelli added that Thomas' employer, William Kunsman and Sons Paving, of Bethlehem, will also not face criminal charges.
He said he did not know whether attorneys will take civil action in the case.
