EASTON, Pa. -

Developer Abe Atiyeh is getting a second chance to push his proposal to build a specialty hospital in Bethlehem.

The Bethlehem Planning Commission last year voted down Atiyeh's plan to build the drug and alcohol treatment center at Center Street and Dewberry Avenue.

A judge has now ruled that the planning commission overstepped its bounds in issuing that decision. The judge said the plans have to go back to the city's zoning hearing board for consideration..

Atiyeh said he doesn't think the zoning board should have a say in the matter, so he's appealing the ruling.
