Grand jury: No charges in deadly shooting of Matthew Kelly in Easton
A man who pulled the trigger in a deadly shooting in Easton last year will not face homicide charges.
Matthew Kelly was killed last April in the city's west ward.
A grand jury investigating the case said Kelly, 20, was trying to rob Brian Simmons when Simmons shot and killed him.
The grand jury determined that Kelly participated in his own death when he ambushed Simmons, who had reasonable belief he would be killed.
As a result of its findings, the grand jury recommended that no homicide charges be filed against Simmons.
The investigation remains open, according to the report from the grand jury, which has not addressed whether anyone else committed criminal acts that could be prosecuted.
