ALLENTOWN, Pa. -

The Lehigh County Controller is responding to legal questions about his eligibility.

District Attorney Jim Martin filed a civil lawsuit last month asking the county court to declare Eckhart ineligible for his position.

Martin says Eckhart has violated state law because he went from being county commissioner to controller without a two-year break in between.

Eckhart's lawyers argue that Lehigh County's home rule charter doesn't have such a provision.

They say state law doesn't apply in this case.
