North Whitehall Township Supervisors voted 3-0 to deny the proposed age-restricted Strawberry Acres project based on non-compliance with a multitude of zoning ordinances during Monday night's meeting.
The vote came only after a request by Richard Somach, legal counsel for developer 5077 Overlook Rd. LLC, for an extension was never acted upon.
The verdict garnered applause from a packed and jammed room of residents, dozens of whom could only find standing room.
Many of those neighbors opposed the proposed plan, which initially called for 144 three-story units on the location of a 140-acre farm that intersects Overlook and Clearview Roads, for a litany of reasons.
Two months ago the developer offered a modified plan that featured more than 80-units. Neither proved suitable for the majority of the 100 residents who turned up Monday night during the past several months.
Residents objected to the project on a myriad of quality of life issues, including environmental concerns about a sewage plant associated with the endeavor.
On Monday night supervisors circumvented those concerns and most public discourse on the matter as no hearing was held.
