Parkland Community Library Files for Injunction
A new library that has been anticipated by Parkland community members for over ten years was threatened to be pushed back even further after a school board shared it's plans to lower a library tax rate.
Parkland School District (PSD) revealed it's plans to reduce a 1998 voter-approved library tax rate of 0.3 mills to 0.1 mills. Reducing this tax rate would continue to post-pone the beginning of construction of a new library.
Though Parkland's plans seem to cause big problems, community members shouldn't worry too much in regards to the anticipated library.
The Court of Common Pleas of Lehigh County, Pennsylvania, Civil Division, attorneys filed an action for declaratory judgment, complaint in mandamus and request for injunctive relief on behalf of plaintiff Parkland Community Library (PCL). The action was taken because of the plans of Parkland School District (PSD) on May 21, 2013.
The hearing will be held on Wednesday, June 19, 2013 at 1:30 p.m. at the Old Courthouse, Lehigh County with Judge Michele A. Varricchio presiding.
When the Parkland School District decided to ignore the special library tax that had previously been approved by voters in 1998 they were going against a public library code that was noted by PCL Legal Counsel Samuel F. Feldman.
"The Public Library Code provides that a special library tax may not be changed without submitting the question to the voters," said Feldman.
Parkland School District is urged to reconsider it's position so that both the school district and the community library may use their resources to continue that quality of services available to the community without causing the taxpayers any inconveniences.
The actions of the PSD Board of Directors severely effects the community in their need for a new library. According to Karl Siebert, PCL Board President, the library has outgrown it's space and is in great need of an expansion due to the fact that the building is now considered one-fifth the size needed to support it's growing population.
