Pa. DoH files brief on gay marriage case in Montgomery Co.

Governor Tom Corbett's administration has taken another step in the legal fight over gay marriage in Pennsylvania.

The state health department has filed a brief detailing its claim against Montgomery County Register of Wills D. Bruce Hanes.

Lawyers say Hanes' decision to issue marriage licenses to same-sex couples risks causing "serious and limitless harm" in Pennsylvania and elsewhere.

The lawyers say it's Hanes' duty to follow a state law that essentially bans gay marriage.

Hanes started issuing licenses after state attorney General, and fellow Democrat, Kathleen Kane said she wouldn't defend the law.
